Host (hereinafter “the Host”): WIX.COM LTD, registered in the INSEE register of companies and establishments under number 808 452 825 00017, with registered office at 40 Port of Tel Aviv, Tel Aviv Jaffa 6350671.

Article 1: Scope of Conditions

These Terms and Conditions of Sale and Use are established between PT Puppy Yoga Bali (hereinafter referred to as “PT Puppy Yoga Bali”) and any entity or individual making a purchase on the Portal (hereinafter referred to as “Buyer”).

1.1 Acceptance: Any order placed implies the Buyer's full and complete acceptance of these Terms, independently of any other document from the Buyer, including specific purchase terms. The Buyer acknowledges having read and accepted these Terms and Conditions at the time of each order.

1.2 Revisions: PT Puppy Yoga Bali reserves the right to revise these Terms and Conditions at its discretion. In such an event, the terms in effect at the time of the order will apply.

1.3 Non-Waiver: PT Puppy Yoga Bali's failure to exercise any of its rights under these Terms and Conditions shall not be construed as a waiver of such right, nor shall it preclude any further exercise of such right.

1.4 Additional Provisions: These Terms and Conditions are subject to additional provisions as set forth herein. All additional provisions are incorporated by reference and are to be understood as part of these Terms and Conditions.

1.5 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Indonesia. Any disputes arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Indonesia.

1.6 Entire Agreement: These Terms and Conditions, along with any documents referred to within, constitute the entire agreement between the Buyer and PT Puppy Yoga Bali and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.

Article 2: Site Management

2.1 Access and Use: For the proper management of the site, the editor may at any time:

Suspend, interrupt, or limit access to all or part of the site, reserve access to the site, or to certain parts of the site, to a specific category of Internet user;
Remove any information that may disrupt the operation of the site or contravene national or international laws, or the rules of Netiquette;
Suspend the site in order to carry out updates.

2.2 User Obligations: Users must comply with applicable laws and regulations and respect the rights of third parties. Users are prohibited from using the site for any illegal or unauthorized purpose.

2.3 Site Availability: PT Puppy Yoga Bali endeavors to keep the site accessible, but cannot guarantee its availability at all times. PT Puppy Yoga Bali shall not be liable for any temporary or permanent unavailability of the site.

Article 3: Prices

3.1 Product and Service Prices: The prices of the products and services offered on the Site are non-negotiable. Any delivery charges are payable by the Customer. The prices of products and services are those in force at the time the order is registered by the Customer.

3.2 Age and Pricing: The prices for the products and services offered by PT Puppy Yoga Bali are standardized and do not vary based on the age of the participants.

Regardless of age, all participants are subject to the same pricing structure. However, it is important to note that there are specific age requirements for participation in the sessions. For regular sessions, participants must be at least 16 years old. For sessions organized in collaboration with associations, the minimum age requirement is 18 years. These age restrictions are in place to ensure the safety and well-being of all participants and to comply with applicable regulations. PT Puppy Yoga Bali reserves the right to request proof of age from participants at any time to verify compliance with these requirements. Failure to meet the age criteria will result in denial of participation in the session without a refund.

Article 4: Payment

4.1 Terms of Payment: Payment of the customer's purchases is made by bank transfer, cash, or PayPal.

4.2 Default of Payment: PT Puppy Yoga Bali reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum due by the customer, or in the event of a payment incident.

4.3 Reservation of Title: It is agreed that products delivered and invoiced to the customer remain the property of PT Puppy Yoga Bali until full payment has been received.

Article 5: Right of Withdrawal and Return

5.1 Withdrawal Period: The customer has up to 48 hours before the start of a session to request a refund or to change the dates of the session initially requested. It has to be warned 72 hours before the start of a sessions for group larger than 4 peoples. No refund will done for children under 16 years old as they are not allowed during the sessions. This change can only be made once. The customer must send an email to the following address: puppyyogabali@hotmail.com.

5.2 Refund Process: In this e-mail, the customer will indicate that he/she can no longer attend the course 48 hours in advance, and will be able to book a new session at no extra cost. PT Puppy Yoga Bali will process the refund within 10 to 12 business days.

Article 6: Orders

6.1 Order Process: The order is made directly on the Site, on the Instagram account, or by WhatsApp. Customers wishing to purchase a product or service must:

Complete the identification form, giving all the contact details requested;
Confirm their order after checking it;
Make the payment according to the terms and conditions;
Confirm the order and payment.

6.2 Order Acceptance: All orders signify irrevocable acceptance of the prices and descriptions of the products and services available for sale, as well as of the present terms and conditions.

6.3 Order Confirmation: PT Puppy Yoga Bali will confirm the customer's order by email within 24 hours.

6.4 Responsibility: PT Puppy Yoga Bali is only bound by an obligation of means for all stages of access to the site, the ordering process, delivery, or subsequent services. PT Puppy Yoga Bali cannot be held responsible for any inconvenience or damage related to the use of the Internet, such as a break in service, external intrusion, or the presence of a computer virus, or any other incident of force majeure.

6.5 Order Modifications: Once an order is confirmed, any modifications are subject to PT Puppy Yoga Bali's approval and may incur additional charges. Customers should contact PT Puppy Yoga Bali as soon as possible to request changes.

6.6 Health and well-being : Participants are advised to prioritize their health and well-being. It is recommended to consult with a healthcare provider before attending sessions, particularly if there are any existing health concerns. For the safety of all attendees, PT Puppy Yoga Bali requires participants to adhere to health guidelines, which include necessary vaccinations as rabies. While PT Puppy Yoga Bali ensures puppies are vaccinated and under regular veterinary care, the organization cannot be held liable for any transmission of conditions between puppies and humans. The complex nature of disease transmission makes it impossible for anyone to prove legally, rationally and objectively the origin of a disease, as contagiousness may have occurred outside these puppies, and the incubation period is too ambivalent to make any link with the activity.

Article 7: Intellectual Property Rights

7.1 Ownership: The Site is a protected work and remains the exclusive property of PT Puppy Yoga Bali, which has created and put online the web pages, images, source scripts, and basic data composing it.

7.2 Use of Content: Unless otherwise stated, PT Puppy Yoga Bali is the owner of the copyrights on each of the pages composing the Site, on its tree structure as well as on each of the elements composing it: trademarks, logos, illustrations, drawings, models, photographs, images and more generally all other elements present on the Site, whether they are registered or not.

7.3 Prohibited Uses: Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, whatever the means or the process used, is prohibited, except prior written authorization of PT Puppy Yoga Bali. Any unauthorized use of the Site or of any of the elements it contains will be considered as constituting an infringement.

Article 8: Image Rights

8.1 Consent to Use of Image: By registering and participating in a puppy yoga class (hereinafter referred to as “the class”) offered by PT Puppy Yoga Bali, you agree to the terms of this clause relating to the use of customer images. This clause governs the use of images, photographs, videos or any other visual content (collectively referred to as “visual content”) taken during the course.

8.2 Use of Visual Content: By agreeing to this clause, you grant PT Puppy Yoga Bali a non-exclusive, worldwide, royalty-free, transferable and sub-licensable license to use, reproduce, modify, publish, translate, distribute, publicly display and perform the visual content captured during the course, for the purpose of promoting and marketing PT Puppy Yoga Bali's course and related activities.

8.3 Responsible Use: PT Puppy Yoga Bali is committed to using the Visual Content responsibly and to respecting your privacy. However, you acknowledge that PT Puppy Yoga Bali cannot guarantee the complete confidentiality of images or videos taken during the course, particularly in the event of hacking or unintentional disclosure.

8.4 Right of Withdrawal: If you wish to request the withdrawal of a specific image in which you appear, you may contact PT Puppy Yoga Bali, providing specific details about the image concerned. PT Puppy Yoga Bali will do its best to process your request as quickly as possible, subject to its legal obligations.

8.5 Limitation of Liability: PT Puppy Yoga Bali will not be held responsible for any unauthorized use of the images by third parties.

Article 9: Force Majeure

9.1 Suspension of Obligations: PT Puppy Yoga Bali's performance of all or part of its obligations shall be suspended in the event of a fortuitous event or force majeure that hinders or delays performance. Such events include, but are not limited to, war, riots, insurrections, civil unrest, strikes of any kind, and supply problems.

9.2 Notification: PT Puppy Yoga Bali will inform the customer of any act of God or force majeure within seven (7) days of its occurrence.

9.3 Resumption of Service: PT Puppy Yoga Bali will make all reasonable efforts to resume normal service as soon as possible after the occurrence of a force majeure event.

Article 10: Liability

10.1 Limitation of Liability: PT Puppy Yoga Bali shall not be liable for consequential damages, including but not limited to loss of profit, data, or use.

10.2 Indemnification: The customer agrees to indemnify and hold harmless PT Puppy Yoga Bali from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or in connection with the customer's use of the Site, participation in sessions, or violation of these Terms and Conditions.

10.3 Third-Party Products: PT Puppy Yoga Bali may provide links to third-party websites or products. PT Puppy Yoga Bali is not responsible for the content, accuracy, or availability of these external sites or resources, and the customer uses them at their own risk.

Article 11: Miscellaneous

11.1 Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.2 Headings: The headings used in these Terms and Conditions are for convenience only and shall not affect the interpretation of the provisions herein.

12.1 No Third-Party Beneficiaries: These Terms and Conditions are intended solely for the benefit of the parties and are not intended to confer any benefits, rights, or remedies upon any person or entity other than the parties.

12.2 Modification of Services: PT Puppy Yoga Bali reserves the right to modify or discontinue any of its services at any time without prior notice. Customers will be notified of significant changes that may affect their orders or sessions.

12.3 Acceptance of Terms: By using the Site and participating in PT Puppy Yoga Bali's sessions, customers acknowledge that they have read, understood, and agreed to these Terms and Conditions in their entirety.

12.4 Binding Agreement: These Terms and Conditions constitute a binding agreement between PT Puppy Yoga Bali and the customer, governing the customer's use of the Site and participation in PT Puppy Yoga Bali's sessions.
